29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.       (a) Roof of the structure: On or about 2/08/2018, and at times prior, the employer exposed employees to fall hazards of up to twenty feet, nine inches, in that the use of personal fall arrest systems was not enforced while the employees were roofing the top of a one story new-build townhouse.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.     a) West side of construction site: On or about 2/08/2019, and at times prior, the employer exposed employees to fall hazards of up to eleven feet, one inch, in that the portable ladder being used to access the work area did not extend at least three feet above the upper landing surface while the employees were working on the roof installing shingles.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) New townhome construction: On or about 2/08/2019, and at times prior, the employer exposed employees to fall hazards of up to twenty-one feet, nine inches, in that they were not trained to properly identify fall hazards, or how to minimize the hazards, prior to working on the roof installing shingles.
