29 CFR 1910.22(c): The employer did not provide, and ensure each employee used, a safe means of access and egress to and from walking-working surfaces: (a) As required by 29 CFR 1926, subpart L, on or about February 13, 2019, the make-shift scaffold (stacked pallets utilized as a temporary elevated work platform) used for the repacking operation was not provided with a safe means of access and egress for employees to utilize. This exposed employees to a fall hazard.

29 CFR 1910.27(a): Scaffolds. Scaffolds used in general industry must meet the requirements in 29 CFR part 1926, subpart L (Scaffolds). (a) On or about February 13, 2019, the make-shift scaffold (stacked pallets utilized as a temporary elevated work platform) used for the repacking operation was not designed by a qualified person as required by 29 CFR part 1926, subpart L, thereby exposing employees to a fall hazard.
