29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: At 1604 South Project, On or about February 13, 2019, and at times prior there to, employees were exposed to struck-by and caught-in hazards associated with excavation work, while installing utility lines without having a competent person recognize the hazards of a possible cave-in.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). At 1604 South Project, On or about February 13, 2019, and at times prior there to, employees were exposed to a cave-hazards while in a trench greater than 6 feet in depth by 12 feet in width by 54 feet in length preparing to install a utility line without an adequate protective system in place.
