29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  (a) New residential construction located on Lot #4, Front side: On or about 02/13/2019, and at times prior, the employer did not maintain a competent person who was aware and who could implement the OSH Requirements governing job site safety. The tubular welded scaffold system used to install exterior brick was not inspected by a competent person prior to the release of the scaffold system to employees.

29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:  (a) New residential construction located on Lot #4, Front side: On or about 02/13/2019, and at times prior, the employer exposed employees to amputation hazards while operating the concrete mixer, in that the starter recoil on the engine was missing, exposing employees to unguarded moving parts.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  (a) New residential construction located on Lot #4, Scaffold section located where employees use the ladder: On or about 02/13/2019, and at times prior, the employer exposed employees to fall hazards of 19-feet to the lower level, in that the working level of scaffold were not fully planked which created a fall hazard accessing the scaffold from the ladder provided.

29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph:  (a) New residential construction located on Lot #4, Scaffold located on front side: On or about 02/13/2019, and at times prior, the employer exposed employees to fall hazards of up to 22-feet, 9-inches while working from a tubular welded scaffold system, in that the scaffold system was not tied into the structure to prevent tipping and collapse while in use.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  (a) New residential construction located on Lot #4, Scaffold located on front side: On or about 02/13/2019, and at times prior, the employer exposed employees to fall hazards of approximately 22-feet, 9-inches, in that employees climbing the upper section of scaffold frames and cross-braces were not provided with a ladder or other safe means of access.
