29 CFR 1926.300(a): Condition of tools. All hand and power tools and similar equipment, whether furnished by the employer or the employee, shall be maintained in a safe condition. On or about February 14, 2019, at Barron Street, Metairie, LA the employer failed to ensure that power tools were maintained in a safe condition. Employee(s) were using the Dewalt grinder on a metal stairwell without the use of the side handle.

29 CFR 1926.300(b)(1): When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use. On or about February 14, 2019, at Barron Street, Metairie, LA the employer failed to ensure that a hand held DeWalt power tool was equipped with a guard. The employee was grinding a metal pole for the stairwell.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. On or about February 14. 2019 at Barron Street, Metairie, LA the employer failed to ensure that employees were protected from a fall by using a personal fall arrest system while working from a JLG Aerial Lift.
