OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or amputation hazard(s) during operation of a downstroke baler. (a) Bubblewrap/cardboard baling area: On or prior to 2/15/19, Piqua HD 2200 downstroke baler did not have a functioning sliding interlocked gate, in that the ram would operate without the loading chamber gate in the down position.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: (a) Densifier process area: On or prior to 2/15/19, the densifier material loading platform was not equipped with a guardrail or equivalent fall protection at the bin unloading area, exposing employees to an 8 foot fall hazard when the forklift and bin was not in position.
