29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  Site: 19 Richardson Street Brooklyn, NY  On or about 2/15/19  a) Employer did not ensure a competent person inspected jobsite, materials and equipment prior to employee working. Employees used a job made ladder that was defective; missing the two top rungs,  signs of fire damage on top side-rails and did not extend 3 feet past the intended landing.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  Site: 19 Richardson Street Brooklyn, NY  On or about 2/15/19  a) Employees used a job made ladder to access the worksite located approximately 8 ft below ground level and the ladder did not extend 3 feet past the landing.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  Site: 19 Richardson Street Brooklyn, NY  On or about 2/15/19  a) Employees used a job made ladder with structural defects to access the worksite approximately 8 ft. below street level.  Two rungs on the ladder were missing and top showed fire damage.
