29 CFR 1910.1200(e)(1): Employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) of 1910.1200 for labels and other forms of warning, safety data sheets, and employee information and training will be met: (a) Denco LLC at 4300 E 51st Ave, Denver CO 80216: On and preceding 2/20/2019, the employer did not develop, implement or maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of 29 CFR 1910.1200 for labels and other forms of warning, safety data sheets, and employee information and training will be met. Employees worked in a cultivation facility that used carbon dioxide for the enrichment of plant growth. This condition exposed employees to chemical hazards associated with the use of chemicals such as, but not limited to, carbon dioxide.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. (a) Denco LLC at 4300 E 51st Ave, Denver CO 80216: On and preceding 2/20/2019, the employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Employees worked in a cultivation facility. The employees were required to wear 1/2 mask tight fitting air purifying respirators with organic vapor cartridges while applying pesticides. The employer did not have a written respiratory protection program. This condition potentially exposed the employees to a respiratory hazard
