OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by flying shrapnel in the event the polyvinyl chloride (PVC) pipe used to transport compressed air were to explode. On or about February 20, 2019 and times prior thereto, the employer had installed schedule 40 PVC pipe used to transport compressed air in the facility used to manufacture plastic parts and clean dust off the processed parts. The installed PVC pipe was not protected against any external forces or stresses. The installed pipe was not designed to transport compressed air.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about February 20, 2019 and times prior thereto, the following machines were not guarded adequately to protect the workers: a) the Haas TL 3 lathe used by employees in producing small round plastic parts did not have the rotating chuck guarded, exposing employee to the hazard of being caught in rotating parts. b) the Haas TM 2 Tool Room Mill used to make specific shape cuts in bigger plastic parts did not have it's point of operation guarded to prevent employees' body parts from entering the point of operation, exposing employees to the hazard of moving machinery parts.
