OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in hazards: On February 18, 2019, in the Steel Stitch Department, the employer did not ensure that the foot pedal control used by the operators of the Ideal Steel Stitches were appropriately guarded against unintentional activation.

29 CFR 1910.212(a)(3)(i): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefore, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about February 18, 2019 an employee operating the Ideal Stitcher, Serial No. 1-19728, was exposed to a caught-in hazard and the employer did not ensure that the point of operation was appropriately guarded.
