29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale (dBA), or equivalently a dose of fifty percent: On or about April 19th, 2019, the employer did not have a continuing, effective hearing conservation program implemented whenever employee noise exposures equaled or exceeded an equivalent dose of fifty percent: a) On or about April 19th, 2019, an employee was exposed to a sound level of 90.9 dBA, or an equivalent dose of 113.2 percent, over the 546-minute sampling period.
