29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or was required to use the respirator in the workplace:   a) Click Go and Buy Inc.,/Avenel, NJ Site:  Plant/Production Areas.  Employees who wear and/or are required to wear half mask respirators for protection against hazardous chemicals and air particulates were not provided a medical evaluation prior to their use of respirators.   Observed on or about 02/22/2019 .

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Click Go and Buy, Avenel, NJ/ Warehouse Floor: A site specific written respiratory protection program that includes, but not limited to training, storage, and maintenance of respirators was not established for employees wearing respirators when conducting spraying operations.  Observed on or about 02/22/2019.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employers were not provided information and training as specified in 29 CFR 1910.1200(h)(2) and (3) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:   A) Click Go and Buy Inc.,/Avenel NJ site: Employees using chemicals such as but not limited to Rust Oleum spray paint and Windex during the painting and cleaning operations were not provided hazard communication training, to identify the health risk associated with its use. The employer failed to provide documentation which included the name of the operator, the date of evaluation and the identity of the person performing the training.   Observed on or about 02/22/2019.
