29 CFR 1910.1200(f)(6): The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required by 29 CFR 1910.1200(f)(5): (a) Gaston Design, Inc.at 1943 K Rd, Fruita, CO: On and before February 25, 2019, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemicals contained within. Two glass jars, containing acetone and PVA-B15 Beads, were stored in a cabinet in the main work area without a label. A bottle of Listerine, containing an unknown liquid, was stored in a cabinet in the main work area. This condition potentially exposed employees to chemical hazards. (b) Gaston Design, Inc.at 1943 K Rd, Fruita, CO: On and before February 25, 2019, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemicals contained within. Two plastic containers with Chemline 11X10-S240 Part A and two plastic containers with Chemline 11X10-S240 Part B were stored in the resin pour area with hand written labels.This condition potentially exposed employees to chemical hazards.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Gaston Design, Inc.at 1943 K Rd, Fruita, CO: On and before February 25, 2019, the employer allowed voluntary use North 7700-30M half-face elastomeric air purifying respirators with organic vapor and P100 cartridges during resin pouring activities but the employer did not provide medical evaluations to determine each employee's ability to use a respirator, before the employee was required to use a respirator in the workplace. This condition may allow employees with pre-existing medical conditions to use respirators when they are not physically capable of doing so. Abatement Note: When tight-fitting elastomeric air purifying respirator usage is voluntarily allowed by the employer, you must ensure that the workers are medically able to wear the respirators. Using a respirator may place a physiological burden on employees that varies with the type of respirator worn, the job and workplace conditions in which the respirator is used, and the medical status of the employee. "Appendix C to Sec. 1910.134: OSHA Respirator Medical Evaluation Questionnaire" contains the mandatory information that employees must complete so that a physician (health care professional) may decide if it is appropriate for the employees to wear a respirator.
