On or about February 27, 2019, located at Lot 66 6813 Brooklyn Heights Rd, Westerville, OH 43081, employees were performing excavation work and installing three and six inch sewer line without any means of protection from cave-ins by an adequate protective system, the employer failed to maintain an effective safety and health program that protected employees from hazards while performing excavation work.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   a. On or about February 27, 2019, located at Lot 66 6813 Brooklyn Heights Rd, Westerville, OH 43081, employees were performing excavation work and installing three and six inch sewer line without any means of protection from cave-ins by an adequate protective system, the employer failed to effectively train employees performing excavation work of the hazards of cave-in, cave-in protection requirements, and methods to provide cave in protection for employees working in trenches.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  a. On or about February 27, 2019, located at Lot 66 6813 Brooklyn Heights Rd, Westerville, OH 43081, employees were performing excavation work and installing three and six inch sewer line without any means of protection from cave-ins by an adequate protective system, the employer failed to ensure cave-in protection was provided for employees working in an open trench, approximately seven to ten foot in depth.
