29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On Feb. 26, 2019, located at a commercial structure, an employee was working from and operating an elevated SkyJack SJlll-3219 scissor lift without the entry chain (midrail) in place at fall heights greater than 23 feet above the concrete surface below. The employer did not instruct employees in the proper use of a scissor lift (scaffold) and in the recognition and avoidance of those hazards of which a reasonably prudent employer would have been aware of while performing this work.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. An employee was working from and operating an elevated SkyJack SJlll-3219 scissor lift without the entry chain (midrail) in place at fall heights greater than 23 feet above the concrete surface below.
