29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:   (a) Reno's LLC on or about February 27th, 2019, at the location of 38 N. Michigan St., Toledo, OH, 43604: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards such as cave-ins during job site operations, decreasing the probability of employee injury and/or illness.  The employees were unable to recognize that they were inadequately protected from hazards while working in a trench and what methods to utilize to adequately protect themselves from cave-in hazards.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) Reno's LLC on or about February 27th, 2019, at the location of 38 N. Michigan St., Toledo, OH, 43604: The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable in regards to the control or elimination of hazards related to trenching and excavation.  Employees were not able to recognize that they were inadequately protected from hazards associated with entering a trench 6.5 feet deep and what methods employees could use to adequately protect themselves from the hazard.

(a) Reno's LLC on or about February 27th, 2019, at the location of 38 N. Michigan St., Toledo, OH, 43604:  Employees were exposed to caught in hazards while working in an excavation 6.5 feet deep that did not utilize an adequate protective system to prevent cave-ins.
