29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about 27 February 2019, and at times prior thereto, four rain gutter installers were performing overhead work without the use of hard hats, exposing the workers to the hazard of being struck by falling tools, materials or debris.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level. On or about 25 February 2019, and at times prior thereto, a rain gutter installer was performing work while on the two-story roof, utilizing a harness, rope and anchor. The rope was approximately 50 feet in length, while the roof edge was approximately 16 feet in height, exposing the two workers to a fall hazard from too much slack in the rope/lifeline.
