29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) New residential construction on Lots #49 and #50, On or about 02/25/2019, and at times prior, the employer failed to provide training to employees to recognize hazards associated with struck-by and fall hazards, in that employees failed to don P.P.E. needed to perform work on the roof and top plates of these residential structures.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  (a) New residential construction on Lot #50, On or about 02/25/2019, and at times prior, the employer  exposed employees to struck-by hazards while operating Hitachi (Model - NR83SA5) 3-1/4-inch Framing Nail Guns, in that protective eyewear was not provided to employees engaged in roof truss installation and operating these tools at 120 PSI.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New residential construction on Lots #49, Roof: On or about 02/25/2019, and at times prior, the employer exposed employees to fall hazards of 21-feet to the lower level, in that employees were not provided with a fall protection system while engaged in roof sheathing activities on a 6/12 pitched roof.   (b) New residential construction on Lots #50, Second floor top plate: On or about 02/25/2019, and at times prior, the employer exposed employees to fall hazards of 19-feet, 9-inches to the lower level, in that employees were not provided with a fall protection system while engaged in roof truss installation activities on a the top plate.
