29 CFR 1910.134(d)(1)(iii) as referenced by 1926.103 and as required by 1960.8(b): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (a) On or about March 4, 2019, maintenance employees were replacing HVAC ducts, working on piping, doors, ceilings, walls, and floors where potential asbestos containing materials were present. No evaluation had been performed for respiratory hazards related to asbestos, and the employees had their respirators taken from them by management. The U.S. Department of Veterans Affairs Northern Indiana Health Care System was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.134(d)(1)(iii) which was contained in OSHA inspection number 1294844, notice number 1, item number 2, and was affirmed as a final order on July 20, 2018, with respect to a workplace located at 1700 East 38th Street, Marion, IN.

29 CFR 1926.1101(f)(2)(i) as required by 1960.8(b): The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace: (a) On or about March 4, 2019, the employer's competent person was not performing asbestos exposure assessments for maintenance work involving HVAC, plumbing, carpentry, and electrical work at the Fort Wayne Medical Center which was built in 1950. The maintenance employees perform their own asbestos assessments based on what they find as they are performing the work. The U.S. Department of Veterans Affairs Northern Indiana Health Care System was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1101(f)(2)(i) which was contained in OSHA inspection number 1294844, notice number 1, item number 4a, and was affirmed as a final order on July 20, 2018, with respect to a workplace located at 1700 East 38th Street, Marion, IN.

29 CFR 1926.1101(k)(8)(vii): The employer identified previously installed presumed asbestos containing material (PACM) and/or asbestos containing material (ACM), labels or signs were not affixed or posted so that employees would be notified of what materials contain PACM and/or ACM, and/or the employer did not post signs in lieu of labels: (a) On or about March 4, 2019, the employer had not labeled ACM or PACM. The asbestos survey lacked a map showing the locations where asbestos samples had been taken, the areas that had tested negative for asbestos were not present, and the areas where asbestos had been removed were not noted in the survey. The U.S. Department of Veterans Affairs Northern Indiana Health Care System was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1101(k)(8)(vii) which was contained in OSHA inspection number 1294844, notice number 1, item number 4b, and was affirmed as a final order on July 20, 2018, with respect to a workplace located at 1700 East 38th Street, Marion, IN.
