OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impact injuries associated with sudden release of the bucket to the ground: (a) Location - 160 County Road, Tewksbury, MA: On or about February 28, 2019, the employer failed to operate an aerial lift safely so that limbs and branches being cut did not affect safety devices and render them inoperable. Among other methods, one feasible and acceptable abatement method to correct this hazard is to create a work plan so that all job tasks do not compromise safety devices on aerial lift equipment.
