29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about February 26, 2019, northeast corner of residential building; employees were observed framing of a residential home under construction without fall protection in place to protect them falling an estimated 35-40 feet to ground level.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) On or about February 26, 2019, north-side front; employees were using an extension ladder to access the third floor with the side rails extended 18-inches above the landing surface, exposing employees to an estimated 20-foot fall.     b) On or about February 26, 2019, third floor west-side area; employees were using a step-ladder to access the upper floor area with the side rails extended 4-feet below the landing surface, exposing employees to an estimated 10-foot fall to the wooden deck area.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet.

29 CFR 1926.1053(b)(6): Unsecured ladder(s) were used on surfaces that were not stable and level:  a) On or about February 26, 2019, north-side front; employees were using an extension ladder to access the  floor third area that was not secured from displacement exposing employees to an estimated 20-foot fall hazard; ladder was set on uneven dirt surface.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a) On or about February 26, 2019; the employer had not certified the fall protection training to employees that were exposed to fall hazards 6-feet or greater while performing framing operations.
