29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   Delcham LLC, failed to provide documentation demonstrating the abatement method and completion of the following items as cited:    a) Citation 1, Item 1: Failed to provide safe rigging, proper bracing to the wood roof trusses installed. b) Citation 1, Item 2a: Failed to provide and implement accident prevention program.  c) Citation 1, Item 2b: Failed to ensure that regular inspections of the jobsite were conducted by a competent person to address unsafe worksite conditions. d) Citation 1, Item 2c: Failed to identify unsafe equipment and did not tag of service; Truslock Space and Brace equipment with bent/worn spurs e) Citation 1, Item 2d: The employer failed to provide head protection to employees working under wood truss setting. f) Citation 1, Item 2e: The employer failed to provide fall protection training to employees working 6 feet and greater during construction. g) Citation 1, Item 2f: The employer failed to ensure that a tag line were used when setting wood trusses. h) Citation 2, Item 1: The employer failed to ensure that employees engaged in construction activities greater than 6 feet were utilizing fall protection.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential struck by hazards from falling or collapsing wood trusses:  On March 6, 2019 new residential construction at Glennview Drive and St Rd 76 in Greenville, employees were exposed to potential falls, struck-by, and crushing hazards by collapsing wood trusses in that:   A: The employer was rigging the trusses from a single point at the peak of the trusses and was not using a spreader bar;  B: An employee was climbing over and in between improperly braced trusses to install Truslock metal space/brace equipment;  C: The trusses were not properly braced to prevent collapse.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary for accident prevention responsibilities.  On March 6, 2019 at Glennview Drive and St Rd 76 in Greenville, employees framing a two story house were exposed to multiple hazards, including but not limited to falls, struck-by, and crushing when the employer had not developed and implemented safety and health programs to identify and communicate recognizable hazards to the exposed employees.

29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On March 6, 2019 at Glennview Drive and St Rd 76 in Greenville, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized fall from elevation hazard associated with an employee working on a wall plate without fall protection equipment, struck-by hazard associated with an employee rigging trusses without utilizing head protection, struck-by and crushing hazards from improperly braced trusses, and damaged metal bracing equipment available/used on site.

29 CFR 1926.1425(c)(3):  When employees are engaged in hooking, unhooking, or guiding the load, or in the initial connection of a load to a component or structure and are within the fall zone, the materials must be rigged by a qualified rigger.  On March 6, 2019 at Glennview Drive and St Rd 76 in Greenville, the employer did not provide qualified rigger training for an employee who did not associate stuck-by and crushing hazards associated with rigging trusses with single point rigging for trusses with base spans greater than thirty-four feet and up to forty-five feet eight inches, without a tagline, and without head protection; trusses were hoisted up to a second employee for securing to the structure.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On March 6, 2019 at Glennview Drive and St Rd 76 in Greenville, an employee was working from an exterior wall top plate and truss bottom chords installing trusses at heights greater than ten feet above surface level without utilizing fall protection equipment.   The Delcham LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1341368, citation number 01, item number 001, and was affirmed as a final order on October 31, 2018, with respect to a workplace located at Faith Ct.; Greenville, WI  54942.
