29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) North Bay Construction, Inc. on or about March 7th, 2019, at the location of 3626 London West Rd., Shelby, OH, 44875: The employer did not instruct each employee in the recognition and avoidance of unsafe conditions to control or eliminate the hazards associated with the operation of a Stihl TS 500i cutting saw. Unsafe operation of the saw as defined by the saw's user manual was performed which exposed employees to struck by hazards from the saw blade becoming pinched and causing strong rotational forced to act upon the saw.

29 CFR 1926.300(c): Employees using hand and power tools and exposed to the hazard of falling, flying, abrasive, or splashing objects, or exposed to harmful dusts, fumes, mists, vapors, or gases were not provided with the particular personal protective equipment necessary to protect them from the hazard: (a) North Bay Construction, Inc. on or about March 7th, 2019, at the location of 3626 London West Rd., Shelby, OH, 44875: The employer did not require the use of gloves when operating the Stilhl TS 500i cutting-saw as required by the saw's operating manual which exposed employees to struck by hazards from flying objects as well as struck by hazards from the saw itself.
