29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a. On or about March 7, 2019, in the in the fabrication area, a welder was exposed to a noise dose of 73%, or an equivalent of 87.8 dBA, as sampling was performed for 410 minutes during one shift on February 7, 2019. The employer failed to administer an effective and continuing hearing conservation program.

29 CFR 1910.133(a)(5): The employer did not ensure that each affected employee used equipment with filter lenses that had a shade number appropriate for the work being performed for protection from injurious light radiation.  a) On or about February 7, 2019, in the plasma cutting area, the employer failed to ensure that employee operating a "Hypertherm Powermax 105" plasma arc cutting equipment and exposed to UV light was protected against radiant energy by using appropriate shade numbers filter lenses. Employee operating equipment plasma arc cutting equipment used dark color safety glasses without a shade number.

29 CFR 1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not protected from the rays by noncombustible or flameproof screens or shields:  a) On or about February 7, 2019, in the general fabrication area, the employer failed to ensure that employees working in areas adjacent where welding operations were conducted with metal inert gas (MIG) equipment were protected from exposure to UV light and against radiant energy by enclosing the operation with noncombustible or flameproof screens or shields.   b) On or about February 7, 2019, in the general fabrication area, the employer failed to ensure that employees working in areas adjacent to the plasma cutter operations (Hypertherm Powermax 105) were protected from exposure to UV light and against radiant energy by enclosing the operation with noncombustible or flameproof screens or shields.
