OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured:    a)Entire facility; On or about March 6, 2019 and times prior, the employer exposed his employees to the hazard of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured. PVC plastic piping was used in exposed above ground locations to transport compressed air at 120 psi.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   a) Production area; on or about March 6, 2019 and times prior the employer exposed employees to hazardous materials such as, but not limited to, fiberglass, resin, and acetone, without implementing a Respiratory Protection Program for those employees required to wear respirators.
