29 CFR 1910.147(c)(7): Training and communication. 29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: 29 CFR 1910.147(c)(7)(i)(B): Each affected employee shall be instructed in the purpose and use of the energy control procedure. On or about March 8, 2019, the employer failed to train affected employees in the purpose and use of the energy control procedure. On March 5, 2019, an untrained employee performing pallet repair duties suffered the partial amputation of two fingers while attempting to reposition a six foot section of guarding on the pallet line conveyor belt.

29 CFR 1910.212(a): Machine guarding. 29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself. On or about March 5, 2018, the pallet line machine guarding for the conveyor belt chain was not adequately affixed to the pallet line conveyor machine housing. A six foot section near Pallet Repair table 1 was missing all three fasteners and was involved with the partial amputation of two fingers while an employee was attempting to reposition a six foot section of guarding on the pallet line conveyor belt. Due to the pallet line conveyor machine guarding being without approximately fifty fasteners, employees were exposed to potential caught-in and pinch point hazards associated with the conveyor belt and associated mechanical components.

29 CFR 1910.1030(c)(1): Exposure control plan. 29 CFR 1910.1030(c)(1)(i): Each employer having an employee(s) with occupational exposure as defined by paragraph (b) of this section shall establish a written Exposure Control Plan designed to eliminate or minimize employee exposure. On or about March 6, 2019, the employer had not established a written exposure control plan to address employee exposure to bloodborne pathogens in the workplace. On March 5, 2019 an employee suffered the partial amputation of two fingers and employees who assisted the employee and performed cleanup of blood in the work area were not protected under this written plan.

29 CFR 1910.1030(g)(2) Information and training. 29 CFR 1910.1030(g)(2)(i): The employer shall train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program. On or about March 5, 2019, the employer had not trained employees with occupational exposure and require participation in a training program that met the elements of 29 CFR 1910.1030(g)(2)(vii)(A)-(N). On March 5, 2019, two employees involved with initial treatment and cleanup of blood from an accident involving the partial amputation of two fingers on the pallet line conveyor belt had not received training from the employer as required under this part.
