29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present using an identity that was referenced on the appropriate safety data sheet (Construction Reference 1926.59):        a.  On or about March 4, 2019, at the tank battery, where ventilation pipe work was being done by employees, the hazard communication program did not include a list of the hazardous chemicals known to be present which included but were not limited to the following:    Crude oil (flammable) in oil and gas production water  Fiberglass (irritant)  SWS-9115 (oxidizer, corrosive)  DS8014 Part A (irritant)  DS8014 Part B (corrosive)  Propane (flammable)    Subcontractor employees and employees were exposed to hazardous chemicals during ventilation pipe work at the gun barrel tanks and when responding to spills of produced water that contained crude oil.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical (Construction Reference 1926.59):       a.  On or about March 4, 2019, at the tank battery, two gun barrel tanks, two produce water storage tanks, and two crude oil storage tanks were not labeled, tagged or marked with either the information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, product identifier and words, pictures, symbols, or combination thereof, which would have provided at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to subcontractor employees and employees under the hazard communication program, would have provided subcontractor employees and employees with the specific information regarding the physical and health hazards of the hazardous chemicals which included but were not limited to crude oil (flammable liquid).  Subcontractor employees and employees were exposed to hazardous chemicals during ventilation pipe work at the gun barrel tanks and when responding to spills of produced water that contained crude oil.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s) (Construction Reference 1926.59):       a.  On or about March 4, 2019, at the tank battery, copies of the required safety data sheets were not maintained and safety data sheets were not readily accessible during each work shift to employees when they were in their work area for each hazardous chemical known to be present which included but were not limited to the following:     Crude oil (flammable liquid) in oil and gas production water   Fiberglass (irritant)   SWS-9115 (oxidizer, corrosive)   DS8014 Part A (irritant)   DS8014 Part B (corrosive)     Subcontractor employees worked at storage and gun barrel tanks to install ventilation piping which exposed them to hazardous chemicals.  Employees were exposed to hazardous chemicals when responding to spills of produced water that contained crude oil.
