29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section.   a) 670 Schillinger Rd N; On or about March 12, 2019 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring 7 feet 1 inch deep, 8 feet 9 inch to 11 feet 6 inch wide, and 43 feet in length that was dug in class "b" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system.  b) 675 Schillinger Rd N; On or about March 12, 2019 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring 6 feet deep, estimated 4 to 10 feet wide, and estimated 15 feet in length that was dug in class "b" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system.

29 CFR 1926.651(b)(4): While the excavation was opened, underground installations were not protected, supported or removed as necessary to safeguard employees:  a) 670 Schillinger Rd N; On or about March 12, 2019 the employer failed to ensure a natural gas pipeline having an unsupported span of approximately 6 feet passing through the excavation was supported to prevent it becoming a hazard to the employees working in the trench.    b) 675 Schillinger Rd N; On or about March 12, 2019 the employer failed to ensure a natural gas pipeline having an unprotected span of approximately 4 feet passing through the excavation was protected to prevent it becoming a hazard to the employees working in the trench.

29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmospheres containing less than 19.5 percent oxygen) or a hazardous atmosphere exists or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation shall be tested before employees enter excavations greater than 4 feet (1.22 m) in depth.  (a) 670 Schillinger Rd N; On or about March 12, 2019 The atmosphere was not tested where the trench was located near a location flammable material (Gasoline Service Station) is stored underground and a natural gas line passes trough the excavation before employee(s) entered an excavation where oxygen deficiency or a hazardous atmosphere existed or could have reasonably been expected to exist as required.  b) 675 Schillinger Rd N; On or about March 12, 2019 The atmosphere was not tested where the trench was located near a location flammable material (Gasoline Service Station) is stored underground and a natural gas line passes trough the excavation before employee(s) entered an excavation where oxygen deficiency or a hazardous atmosphere existed or could have reasonably been expected to exist as required.
