29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: On, or about, March 14, 2019, employees of M. Rivera Construction, Inc., subcontracted by Greenspace Construction Services, LLC, at the New South High School Construction Project located at 5000 Shankland Road, in Willoughby, Ohio were exposed to 15 feet falls. Employees performed cleaning activities and were working near a second floor, double door wall opening, and were not protected from falls by the use of a guardrail system, a safety net system, or a personal fall arrest system.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: On, or about, March 14, 2019, employees of M. Rivera Construction, Inc., subcontracted by Greenspace Construction Services, LLC, did not ensure that each employee at the New South High School Construction Project located at 5000 Shankland Road, in Willoughby, Ohio, 44094 was trained in the use and operation of personal fall arrest systems while engaged in cleaning tasks, such as trash receptacle emptying near a second floor, unguarded opening, when elevated 15 feet above ground level and expected to use a personal fall arrest system.
