29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect employee health or whenever respirators are required by the employer, a written respiratory protection program that included the provisions in 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented. On or about March 13, 2019 and at times prior thereto, an employee was required to wear a respirator during tasks including but not limited to painting operations, exposing the employee to the hazards of respirator use. The employer did not implement or provide a written respiratory protection program including but not limited to the following: a) Ensuring employees were medically cleared to wear a respirator. b) Ensuring employees were fit tested to wear selected respirator. c) Training on proper use and care of respirators.
