29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: The employer is failing to ensure employees are protected from fall hazards associated with walking out on a balcony that does not have a proper guardrail. This was most recently evident during the inspection conducted on March 14, 2019 at a worksite located at 927 7th St., David City, NE 68632. Two employees routinely use the balcony to get to the roof of the facility. The balcony has a parapet wall that only extends approximately 1.75 feet high exposing employees to a fall hazard.

29 CFR 1910.29(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches, plus or minus 3 inches, above the walking-working surface: The employer is failing to ensure employees are protected from fall hazards associated with walking out on a balcony that does not have a proper guardrail in place. This was most recently evident during the inspection conducted on March 14, 2019 at a worksite located at 927 7th St., David City, NE 68632. Two employees routinely use the balcony to get to the roof of the facility. The balcony has two parapet walls but the top of the walls only extend approximately 1.75 feet high. Over the side of one of the walls there is a drop of approximately 12.2 feet to the sidewalk below.

29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee was protected from falling through any hole (including skylights) that was 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems. The employer is failing to ensure employees are protected from fall hazards when walking on a flat commercial roof where skylights are installed. This was most recently evident during the inspection conducted on March 14, 2019 at a worksite located at 927 7th St., David City, NE 68632. Two employees routinely access the roof for maintenance purposes. There are five skylights located on the roof and none of them have any form of protection to prevent employees from falling through them. In this instance an employee fell through one of the skylights approximately 12.5 feet and sustained injuries resulting in a hospitalization.
