OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling wood trusses:    Van Rite & Father, Inc. at the work-site located at 1680 Mid Valley Rd., De Pere, WI: On or about March 18 and 19, 2019 employees squaring roof trusses and installing bracing were exposed to struck-by hazards while working on and/or under trusses that had not been braced to resist roll-over and/or collapse due to the lack of top chord lateral bracing, the lack of top chord diagonal bracing, the lack of bottom and web member bracing.

29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees:       On or about March 19, 2019 the employer did not require employees expose to falling objects and/or debris to wear personal protective equipment (PPE) such as, but not limited to safety glasses, hard hats, etc.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.    On or about March 19, 2019 the employer did not ensure the Caterpillar Telehandler, equipped with a metal man-basket, was to identify the attachment and it's effect on the vehicle's capacity.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:     On or about March 19, 2019 the employer did not provide employees working from elevated surfaces above six feet with training to ensure they were able to recognize fall hazards and the implementation of procedures to minimize fall hazards.
