29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: a) Studio Apartment Bathrooms - The employer did not assess employee exposure to silica when working with "Quikrete Sand Mix", on or about March 18th, 2019. b) Studio Apartment Bathrooms - The employer did not assess employee exposure to silica when working with "Laticrete 4-XLT" and "Laticrete Tri-lite", on or about March 19th, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
