29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system:  a) Batch Plant: On or about March 19, 2019, a worker was exposed to fall hazards while working from the ten foot, two inch high mortar silo platform without having the platform entrance top and midrail chains secured to protect the ladder entrance opening. 29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a) Batch Plant: On or about March 19, 2019, a worker was exposed to hazards of prolonged contact with caustic materials such as, but not limited to, portland cement, while performing loading and mixing tasks above and below the Quikrete silo without the benefit of a facility to quickly drench affected eye and body parts. 29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  a) Establishment and temporary sites: On or about March 19, 2019, and at times prior, The employer did not implement a written respiratory program to address potential respiratory hazards associated with, but not limited to, portland cement, a caustic substance, where the employer required employees to wear N95 masks during batch plant operations that exposed workers to nuisance dust and other potential hazards related to the respiration of portland cement. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Establishment: On or about March 19, 2019, and at times prior, workers were not provided with training to detect and/or minimize airborne portland cement dust and measures workers can take to prevent exposure to eye and respiratory contact, including, but not limited to, silo filling operations and batch mixing, in that a work procedure created a significant dust cloud of portland cement, a caustic material, while the worker did not have adequate protection for eyes, respiratory system, or immediate wash facilities in the area.
