29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:  (a) On or about April 23, 2019 - The employer failed to provide the abatement documentation for Citation 1, Item 1 as required.  (b) On or about April 23, 2109 - The employer failed to provide the abatement documentation for Citation 1, Item 2 as required.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 03/20/2019 - Griffin Lake Trace,  Lot #116 in Birmingham, Alabama, employees were exposed to fall hazards while removing and installing sheathing on a steep roof with an 8:12 pitch at approximately 21 feet 6 inches above ground level.  Saul Antonio Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1259007, citation number 1, item number 1 and was affirmed as a final order on 12/21/2017, with respect to a workplace located at 285 Silver Creek Parkway, Alabaster, Alabama 35007.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill:  a) On or about 30/20/2019 - Griffin Lake Trace,  Lot #116 in Birmingham, Alabama, employees who have been trained in fall protection, were exposed to fall hazards of approximately 21 feet 6 inches above lower level while installing sheathing.  Saul Antonio Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(c)(3), which was contained in OSHA inspection number 1259007, citation number 2, item number 2 and was affirmed as a final order on 12/21/2017, with respect to a workplace located at 285 Silver Creek Parkway, Alabaster, Alabama 35007.
