29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). On or about March 20, 2019 and before, the employer failed to take powered industrial trucks out of service that had damaged/worn tires thereby exposing operators and other employees to struck-by hazards associated with forklift operation. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
