29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:  On or about March 21, 2019, in the Advantage Redi-Mix, LLC facility where employees were exposed to eye hazards from flying Portland cement, sand, and aggregate and did not have safety glasses available.   Instance a) In the concrete batch plant where the plant operator did not have safety glasses and was exposed to eye injury hazards.    Instance b) In the concrete batch plant where a driver did not have safety glasses and was exposed to eye injury hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   (a) In the Advantage Redi-Mix, LLC facility where the employer had not developed, implemented, and maintained at the workplace a written hazard communication program for employees who were exposed to chemicals including, but not limited to Portland cement.
