29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: (a) Fairview Apartment Project: On or about March 19, 2019 and at time prior to, the walking, working and traveling paths of the jobsite were obstructed by cords, tools and building materials. Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) South building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, employees were installing floor joists at 10 feet above the ground with no fall protection in place. (b) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, employees were exposed to an approximate 8-10 foot fall through a 23"x48" ladder access hole due to lack of fall protection guarding. (c) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, employees were exposed to an approximate 20 foot fall through a wall opening that had not been guarded.

29 CFR 1926.100(b): Helmets for the protection of employees against impact and penetration of falling and flying objects did not meet the specifications contained in American National Standards Institute Z89.1-1969, Safety Requirements for Industrial Head Protection (a) Fairview Apartment Project: On or about March 19, 2019 and at times prior thereto, employees were wearing "hats" underneath their hard hats which led to hard hats not fitting the employees properly.
