29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems or a combination of warning line system and safety monitoring system:    On or about 21 March 2019, employees were exposed to fall hazards approximately 35 feet while engaged in roofing activities on a low-sloped roof.  Fall protection was not being utilized.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:    On or about 21 March 2019, at the above addressed jobsite, employees were working from an elevation greater than 35 feet. The employer failed to provide fall protection training to three employees. Discussion with Mr. Gerry Haan indicated that Hector Bajaras was trained in 2002, but the other employees were not trained in a program specific to fall hazards that enables employees to recognize and minimize fall hazards that were present.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.252(a): Whenever materials are dropped more than 20 feet to any point lying outside the exterior walls of the building, an enclosed chute of wood, or equivalent material, shall be used. For the purpose of this paragraph, an enclosed chute is a slide, closed in on all sides, through which material is moved from a high place to a lower one.  On or about 21 March 2019, at the above addressed jobsite, employees were dumping materials from a rooftop utilizing a wheelbarrow at approximately 35 feet above ground, onto a non-enclosed tarp that slid trash from the rooftop into dumpsters at ground level. The employer failed to ensure that an enclosed chute that is closed in on all sides, was being used to move material from a high place to a lower one. Employees were thereby exposed to fall hazards from this height due to dumping the trash off the roof.   No abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
