29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) On or about 3/20/19, in an excavation in the middle of the street approx. in front of a house located at 130 Lafayette Ave., Buffalo, NY: An employee was doing plumbing work such as making water line connections in an excavation that was 10 ft. x 10 ft. x 5 ft.8 in. to 6 ft. 8 in.deep. The walls of the excavation were vertical, and the employee was not wearing a hardhat. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about 3/20/19, in an excavation in the middle of the street approx. in front of a house located at 130 Lafayette Ave., Buffalo, NY: An extension ladder had been placed in the excavation on the east end, and was used by an employee to enter & exit the excavation. The side rails of that ladder only extended 8 inches above the street. NO ABATEMENT CERTIFICATION REQUIRED
