29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.   (a) In regards to citation 2, item 1, issued on April 12, 2019, the employer failed to submit abatement certification within ten days of the abatement date, May 3, 2019.  The violation read as follows:   29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training or  when employer relied on training conducted by another employer, the certification record needs to indicate the date the employer determined the prior training was adequate rather than the date of actual training, and the signature of the person who conducted the training or the signature of the employer:  (a) 2305 Corona Ave, Eau Claire, WI., apartment # 2309; The employer did not provide certification of fall protection training.

29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  In regards to citation 1, item 1, issued on April 12, 2019, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, May 3, 2019.  The violation read as follows: 29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) 2305 Corona Ave, Eau Claire, WI., apartment # 2309;  Employee(s) were allowed to walk/work from areas greater than 6 feet above ground level without adequate fall protection.  In regards to citation 1, item 1, issued on April 12, 2019, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, May 3, 2019.  The violation read as follows:  29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels were not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a) 2305 Corona Ave, Eau Claire, WI., apartment # 2309; Employee(s) removing shingles from a steep sloped roof were not utilizing fall protection when working at a fall height greater than 6 feet above ground level.
