29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a)Crowley Construction at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the exposing employer did not ensure forklift operators were trained in the operation of powered industrial trucks in that, operators were not trained in the use of the JLG G-9-43A Rough Terrain Forklift prior to use. An employee was operating the rough terrain forklift and lifting employees on a personnel platform to install soffit on a multi-family home under construction. This condition exposed the employees to the hazard of improper forklift operation.     Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    Abatement Note: The requirements applicable to construction work under this paragraph are identical to those set forth at �1910.178(l) of this chapter.

29 CFR 1926.451(g)(1): Each employee on a scaffold 10 feet above a lower level were not protected from falling to the lower level:       (a)Crowley Construction at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the exposing employer did not ensure employees were protected from a fall hazard in that, guardrails or other suitable fall protection was not installed on the personnel platform connected to the JLG G-9-43A Rough Terrain Forklift being used to install soffit on a multi-family residence under construction. This condition exposed the employees to the hazard of a fall of approximately 16 feet.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:      (a)Crowley Construction at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the exposing employer did not ensure that each employee engaged in framing operations on a multi-family residence under construction were protected from injury in that, an employee accessed the roof to assist another employee by providing material to an employee installing soffit from a personnel platform below the roof line. This condition exposed employees to falls in excess of 8 feet.    (b)Crowley Construction at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the controlling employer did not ensure that each subcontractor employee engaged in stucco installation on a multi-family residence under construction were protected from injury in that, subcontractor employees accessed a deck and were exposed to fall hazards. This condition exposed subcontractor employees to a fall hazard of approximately 12 feet.    (c)Crowley Construction at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the controlling employer did not ensure that each subcontractor employee engaged in roofing installation on a multi-family residence under construction were protected from injury in that, subcontractor employees conducted roofing operations without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 18 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:     (a)Crowley Construction at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the exposing employer did not ensure that each employee engaged in framing operations on a multi-family residence under construction recognize the hazards associated with working at elevations over 6 feet. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The employer did not provide training on fall protection systems involving its limitations and use. The condition exposed employees to the hazard of falling from an elevation of approximately 18 feet while on the roof providing materials to an employee installing soffit on a personnel platform below.
