29 CFR 1926.20(b)(2):  The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)AmWall, LLC at 2511 & 2515 Paramount Drive, Spearfish, SD 57783:  On or about and at times prior to March 21, 2019,  the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards associated with employees working on a deck of a multi-family home under construction. This condition exposed employees to a fall hazard of approximately 12 feet.        Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:       (a)AmWall, LLC at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the exposing employer did not ensure that each employee engaged in stucco operations on a multi-family residence under construction were protected from injury in that, employees were working on a deck while exposed to fall hazards. This condition exposed employees to a fall hazard of approximately 12 feet.

The condition exposed employees to the hazard of falling from an elevation of approximately 12 feet.
