29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:       (a)Leth Roofing, LLC at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the exposing employer did not ensure that each employee engaged in roofing operations on a multi-family residence under construction were protected from injury in that, employees were installing a new roof while exposed to fall hazards. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:       (a)Leth Roofing, LLC at 2511 & 2515 Paramount Drive, Spearfish, SD 57783: On or about and at times prior to March 21, 2019, the exposing employer did not ensure that each employee engaged in roofing operations on a multi-family home, had been trained to recognize the hazards associated with working at elevations over 6 feet. Employees working on-site had not received fall protection training before working at elevations over 6 feet.  The condition exposed employees to the hazard of falling from an elevation of approximately 10 feet.

29 CFR 1926.1053(b)(1): A portable ladder was used for access to an upper landing, but the ladder side rails did not extend at least 3 feet above the upper landing, nor was the ladder secured:     (a)Leth Roofing, LLC at 2511 & 2515 Paramount Drive, Spearfish, SD 57783:  On or about and at times prior to March 21, 2019, the exposing employer did not ensure that a portable extension ladder, used to access the roof of a multi-family residence under construction, had side rails extending 3 feet above the upper landing, and was secured. This condition exposed three employees to fall hazards of approximately 10 feet.
