29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:(Construction Reference: 1926.602(d)) Jobsite located at 7020 W. 108th St. Overland Park, KS 66211, employees engaged in operating a forklift (CATTH580B Model #HSLH00332, Serial #CRX04569) to raise the guardrail of the scaffold, and employees working in the area, were exposed to struck-by hazards in that the forklift operator had not completed the required training. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.

29 CFR 1926.451(e)(1): 29 CFR 1926.451(e)(1): Cross braces were used as a means of access and egress: Jobsite located at 7020 W. 108th St. Overland Park, KS 66211, employees engaged in plastering activities ascending onto the tubular welded frame scaffold were exposed to fall hazards of approximately 45 to 75 feet to the ground below in that the cross braces, and scaffold end-frames were used as a means to climb to the next level in lieu of ladders. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section: Jobsite located at 7020 W. 108th St. Overland Park, KS 66211, employees engaged in plastering activities from the walking/working surface of a tubular welded frame scaffold were exposed to fall hazards of approximately 45 to 75 feet from the walking/working surface/level of the scaffold to the ground below. Employees were exposed in that fall protection was not provided. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
