29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    On 3/26/2019, employees of Five Star Builder, LLC were working on a residential building located at Lot 20 Boxcar Drive, Troy, Missouri.  Employees have not received instruction or training by the employer in recognizing, eliminating or controlling hazards associated with the scope of work.  Employees are regularly exposed to fall and struck by hazards.

The program did not enable each employee to recognize the hazards of falling and did not train each employee in the procedures to be followed in order to minimize these hazards.  On 3/26/2019, employees of Five Star Builder, LLC were working on a residential building located at Lot 20 Boxcar Drive, Troy, Missouri.  The employees were not able to recognize fall hazards and the procedures necessary to reduce or eliminate these hazards.

29 CFR 1926.501(b)(4)(i):  Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.    On 3/26/2019, employees of Five Star Builder, LLC were working on a residential building located at Lot 20 Boxcar Drive, Troy, Missouri.  Employees were working near an unprotected hole in the floor.  Employees were exposed to a fall of approximately 9 feet to a lower level.

Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening was less than 39 inches (1.0 m) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.     On 3/26/2019, employees of Five Star Builder, LLC were working on a residential building located at Lot 20 Boxcar Drive, Troy, Missouri.  Employees were performing work on the second floor, installing windows through a wall opening, which was approximately nine feet above the ground.  The employees were exposed to fall hazards through wall and window openings which were not guarded.
