29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge:  a) Building G: On or about March 19, 2019, and at times prior thereto; three flights of stairs for this apartment building was missing a stair rail system, exposing employees to an unprotected side and edge.           Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(1): Employees on walking/working surfaces with an unprotected side and/or edge which is 6 feet or more above a lower level were not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:  a)  Building G:  On or about March 19, 2019: the General Contractor with controlling and correcting authority did not ensure subcontractors were following site health and safety plan rules; Sub-contracted employees performing framing activities were exposed to a fall hazard while walking the exterior top plate without a means of fall protection and exposed to an approximate 30 foot fall hazard.  b)  Building G:  On or about March 19, 2019; the General Contractor with controlling and correcting authority did not ensure subcontractors were following site health and safety plan rules; Sub-contracted employees performing framing activities were exposed to fall hazards from the balcony and/or windows that were not equipped with guard railing.  c)  Building H:  On or about March 19, 2019; the General Contractor with controlling and correcting authority did not ensure subcontractors were following site health and safety plan rules; Sub-contracted employees performing framing activities were exposed to fall hazards from the balcony and/or window were not equipped with guard railing.  Note: Abatement certification and documentation ARE required for this item.  Dave Evans Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1151926, citation number 1, item number 1b and was affirmed as a final order on August 2, 2016, with respect to a workplace located at 485 East 50th Street, Garden City, Idaho 83714.  Dave Evans Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1367182, citation number 1, item number 1 and was affirmed as a final order on March 22, 2019, with respect to a workplace located at 14102 Highway 55, McCall, Idaho 83638.
