29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe: (a) New townhome construction located on Lots 47-53, Cut bench located on front side of structure: On or about 03/26/2019, and at times prior, the employer exposed employees to severe laceration and amputation hazards while operating circular saws, in that the lower guard of the saw was placed in the fixed upward position with shims and nails which prevented the guard from retracting after a cut had been made. CSHO observed three saws with no lower guard in place.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction located on Lots 47-53, Roof: On or about 03/26/2019, and at times prior, the employer exposed employees to fall hazards of more than 10-feet, 4-inches from the lower level, in that fall protection was not provided to employees engaged in siding activities on a 4/12 pitched roof.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) New townhome construction located on Lots 47-53, Front side: On or about 03/26/2019, and at times prior, the employer exposed employees to fall hazards of 10-feet, 4-inches and greater, in that the ladders used to access the roof were not extended at least 3-feet or secured to the structure to allow for safe access to the upper and lower levels.
