OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from direct contact with dairy cows:    On or about March 31, 2019 the employer did not ensure employees working in direct contact with dairy cows in the milking parlor, the adjacent platform(s), pens, holding area and/or return lanes, were protected from struck-by hazards.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor:     On or about April 2, 2019 the employer did not meet the reporting requirement for reporting a work-related fatality to OSHA within eight hours from the time of the incident.
