29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a) EI Martinez Construction at 2870 Duke Cir. Boulder, CO 80303: On or before 4/2/19 the creating and exposing employer did not protect employees from injury in that  employees installing siding on a pump jack scaffold were not using one or more methods of approved fall protection. The scaffold deck was approximately 16 feet above grade. This condition exposed employees to a fall hazard of 16 feet.

29 CFR 1926.451(f)(7):  Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration;  such activities were not performed only by experienced and trained employees selected for such work by the competent person.  a)  EI Martinez Construction at 2870 Duke Cir. Boulder, CO 80303: On or before 4/2/19 the creating and exposing employer did not ensure that scaffolds were erected, moved, dismantled, or altered by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection.  Employees had erected a pump jack scaffold that was used without guardrails.  The scaffold deck was approximately 16 feet above grade. This condition exposed employees to a fall hazard of 16 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a) EI Martinez Construction at 2870 Duke Cir. Boulder, CO 80303: On or before 4/2/19 the creating and exposing employer did not ensure that employees were trained in the recognition of hazards in scaffolds. Employees were working on a pump jack scaffold and were not using one or more methods of approved fall protection. The scaffold was not erected correctly and was missing structural components. The scaffold deck was approximately 16 feet above grade. This condition exposed employees to a fall hazard of 16 feet.

Boulder, CO 80303: On or before 4/2/19 the creating and exposing employer did not ensure that employees engaged in erecting a pump jack scaffold were trained in the recognition of hazards and safe assembly of the scaffold. The scaffold was missing structural components and guard rails. This condition exposed employees to a fall hazard of 16 feet.
